For the purposes of these Terms and Conditions ("T&C"), "Luce Infinita" refers to the entity identified above, and "user", "customer" or "you" refers to any person who accesses or purchases through the website.

2. Purpose and acceptance

These T&C govern access to and use of the website, as well as the purchase of cosmetic and skincare products sold by Luce Infinita. Luce Infinita sells its products to customers in the European Union, the United States of America, and any other country, subject to the shipping options available at checkout; some of the rights described in these T&C vary depending on the customer's country of residence, as indicated in the relevant clauses. By browsing the website, creating an account, or completing an order, the user confirms that they have read, understood, and accepted these T&C in full, as well as our Privacy Policy and our Cookie Policy.

If you do not agree with any of these terms, you should refrain from using the website or purchasing our products.

3. Who may purchase

Purchases are restricted to individuals who are at least 18 years old and have the legal capacity to enter into binding contracts. By placing an order, the user confirms that these conditions are met and that the information provided is true, complete, and up to date.

4. User account

Creating an account is optional but required for certain features (order history, wish list). The user is responsible for keeping their password confidential and for all activity carried out through their account. Luce Infinita reserves the right to suspend or cancel accounts in cases of fraudulent or abusive use, or use contrary to these T&C.

5. Products and availability

We make a reasonable effort to ensure that product photographs, descriptions, and colors accurately reflect the actual item; however, slight variations may occur due to screen settings or manufacturing batches. All products are subject to stock availability. Luce Infinita reserves the right to discontinue, reformulate, or update its product range at any time, without affecting orders already confirmed.

6. Prices and payment methods

All prices are displayed in euros (€), US dollars ($), or may be shown in the local currency depending on the billing country, and include applicable VAT unless otherwise stated. VAT is always borne by the buyer and is included in the final price shown on the website.

For orders shipped outside the European Union, including to the United States, the displayed price may not include local taxes (such as sales tax) or import duties that may apply in the destination country; where applicable, these charges are the buyer's responsibility and are collected by local authorities or the carrier at the time of delivery.

Shipping costs are calculated and shown separately before checkout is completed. Luce Infinita reserves the right to change prices at any time, without affecting orders already confirmed and paid for.

We accept the payment methods listed at checkout (credit/debit card and any other options shown there), processed through certified payment providers. We do not store full payment card data on our servers.

7. Order process

An order constitutes a contractual offer from the customer, which becomes binding on Luce Infinita only once confirmed by email. We reserve the right to refuse or cancel orders in cases of stock unavailability, an obvious pricing or description error, or suspected fraud, notifying the customer and refunding any amount already paid.

8. Right of withdrawal

Under Directive 2011/83/EU, customers who qualify as consumers and reside in the European Union, the European Economic Area, or the United Kingdom have 14 calendar days from receipt of the product to exercise their right of withdrawal from the contract, without needing to give a reason and without incurring any costs beyond the direct cost of returning the goods.

Luce Infinita extends this same 14-day period, under the same conditions, to customers in any other country, including the United States, even where local law does not require it. This extension is a Luce Infinita commercial policy and not a right imposed by foreign law.

To exercise this right, the customer must inform Luce Infinita of their decision through a clear statement (for example, by email to luce@luceinfinita.com); the withdrawal form template provided at the end of this document may be used for this purpose.

Important exception for cosmetic products. Under Article 16(e) of Directive 2011/83/EU — applied by Luce Infinita as a standard for all customers, regardless of country — the right of withdrawal does not apply to sealed goods which are not suitable for return for health or hygiene reasons once opened or once the protective seal has been removed after delivery. Accordingly, perfumes, creams, serums, and other cosmetic products may only be returned under this right while their original seal/protection remains intact.

9. Shipping and delivery

Delivery times shown on the website are estimates and may vary depending on the destination and carrier. Luce Infinita is not liable for delays caused by events beyond its reasonable control (strikes, weather conditions, customs incidents, among others). The risk of loss or damage to the product passes to the customer upon delivery at the address provided.

10. Returns, exchanges, and refunds

In addition to the right of withdrawal set out in section 8, we accept returns of defective products or products shipped in error on our part, under the terms of section 11. Refunds are issued using the same payment method used for the purchase, within a maximum of 14 days from receipt of the returned product or proof that it has been shipped back, whichever occurs first.

11. Legal guarantee of conformity

Under Directive (EU) 2019/771, Luce Infinita guarantees to customers resident in the European Union and the European Economic Area that products are delivered in conformity with the contract, and is liable for any lack of conformity that exists at the time of delivery and becomes apparent within two years. This legal guarantee is free of charge and is in addition to any commercial warranty that may be offered.

For customers outside the European Union, including in the United States, Luce Infinita applies, as its own commercial policy, the same warranty conditions described above, without prejudice to any additional guarantees provided under the customer's local law (in the USA, in particular the implied warranties under applicable state law and the Magnuson-Moss Warranty Act).

12. Intellectual property

All content on the website — including, without limitation, the "Luce Infinita" brand, logo, text, photographs, videos, and design — is the property of Luce Infinita or its licensors and is protected by copyright and industrial property rights. Reproduction, distribution, or commercial use of this content without prior written authorization is prohibited.

13. Limitation of liability

To the fullest extent permitted by law, Luce Infinita is not liable for indirect damages, loss of profits, or data loss resulting from use of the website. Nothing in these T&C excludes or limits Luce Infinita's liability in cases where applicable law does not permit it to do so, in particular in cases of intent, gross negligence, or personal injury.

We recommend performing a skin sensitivity test before first using any product and reading the ingredient list, especially in the case of known allergies.

14. Personal data

The processing of personal data carried out through this website is governed by Regulation (EU) 2016/679 (GDPR) and is detailed in our Privacy Policy, which describes the purposes of processing, the legal basis, retention periods, and the data subject's rights (access, rectification, erasure, portability, objection, and restriction of processing), exercisable via luce@luceinfinita.com.

For customers residing outside the European Union, other local data protection laws may additionally apply (for example, state privacy laws in the United States), without prejudice to the protection standards already described in our Privacy Policy.

15. Changes to these terms

Luce Infinita may amend these T&C at any time, to reflect legal changes or changes to the website's activity. The version applicable to each order is the one in force at the time the order was placed. Material changes will be communicated via the website or by email.

16. Dispute resolution

In the event of a complaint, the customer should first contact us at luce@luceinfinita.com so that we can seek an amicable solution. Customers resident in the European Union may also refer the matter to an alternative dispute resolution body or, under Regulation (EU) No 524/2013, use the European Online Dispute Resolution (ODR) platform, available at ec.europa.eu/consumers/odr.

This platform is available only to consumers resident in the European Union. Customers in other countries, including the United States, may file complaints with the consumer protection bodies applicable in their country of residence, without prejudice to direct contact with Luce Infinita as indicated above.

17. Governing law and jurisdiction

These T&C are governed by Brazilian law. Without prejudice to any mandatory consumer protection rights under the law of the customer's country of residence, the competent court for resolving any disputes is that of Lages/SC, Brazil, unless otherwise required by law.
